I was employed by the MoD(UK) in security work, and the contract of employment clearly stated that I was entitled to shift payments, as did German Employment Law. Because I was denied these payments I was forced to take legal action. A German Government lawyer had decided that I was not entitled to shift payments because I lived 300mtrs from work. This was upheld by the court in the final verdict, even though my colleagues lived up to 91kms from work, and they also did not receive shift allowances. This verdict was acheived because the court had been fixed. I say this because I ended up having a lawyer planted on me at the final hearing, who I had never met before. He was not a lawyer in the employment area of specialisation. Furthermore, he said precisely nothing in court, except his name. He also attended without any case papers at all. Due to the fact this lawyer was remaining silent I asked a question myself, which would have wrecked the employers defence. The judge, who was also new to the case, stopped the tape recorder and duly wound it back and recorded over what I had said, she did not answer my question, preferring to turn towards the employers bench and have a secret conversation. She was infuriated by my speaking on my own behalf due to the cirumstances. As a result of the verdict I used the services of another lawyer to attempt to appeal the case. He immediately took me on as a client, this was confirmed in writing even before he had seen the judgment. After having studied the judgment he duly wrote saying that he was withdrawing, because he could not see how I could win. This was not true because the MoD(UK) when asked about my being able to walk to work and that of my colleagues who lived up to 91kms away, duly replied in writing that where I lived had got nothing to do with the entitlement to shift allowances. This was an admission that they had lied in court and perfect grounds to justify an appeal. Another lawyer I contacted admitted that lies are acceptable in German courts, when trapped by the same point in the judgment. Therefore, he had admitted they were lying, yet he still refused to appeal my case. His written excuse, confirmed by his backing of the judgment mean that lies are accepted on behalf of the authorities. Due to my ongoing investigation, I discovered legislation from the Hitler period, that is still on statute in Germany, namely, the Law on Legal Advice 13th December 1935. This law is used today, exactly as it was originally intended, not as the German Ministry of Justice claims, that it now protects the client, by guaranteeing that only lawyers can give legal advice, therefore, a person cannot lose a case through bad advice. This does not hold true because the lawyer I had planted on me, remained silent in court. This law totally dominates the legal profession in Germany, to the detriment of the client, if the government does not want to lose a case where it is the defendant. Because of insistance to my employer, that I must resist their overthrow of the Constitution, which their court rigging had done, I was dismissed. I could not contest anything in this whole case due to the fact that I had been stripped of the right to legal representation due to the NAZI law. This case has also involved written threats, that were later admitted as being incorrect, by a British Army Officer. The German media will not touch my case because they have to get legal advice also due to the same NAZI legislation. A lawyer will not allow publication because his permit to be a lawyer is given through this law. If he goes against the governement his permit is withdrawn. I have written to President Barroso and spoken to someone in his office who admitted the judgment cannot be correct, they still refused to act on my behalf, to defend Democracy. All the evidence is in writing to support this case. Yours faithfully, Michael Smith.
