In Election Season, Mum’s the Word about Gun Control
By Don B. Kates Jr.

Are this year’s U.S. presidential candidates avoiding the gun issue?

Last week, San Francisco’s First District Court of Appeal struck down that city’s two-year-old law that confiscated all handguns and rendered all other guns useless by banning ammunition sales. And on March 9 of last year, a federal court of appeals invalidated District of Columbia laws that banned handguns and precluded keeping any gun for defense in the home. That case is now in the Supreme Court, which many expect will hold that such laws violate the Constitution’s guarantee that law-abiding, responsible adults may have guns to defend their homes and families.

Ironically, though these laws represent the ultimate goals of the gun “control” (actually gun ban) movement, they epitomize that movement’s political downfall. For Democratic candidates, an Eleventh Commandment has evolved: “Don’t mention guns”—while formerly anti-gun Republicans Romney and Giuliani now declare themselves faithful advocates of gun rights.

Democratic politicians are well aware that (as Bill Clinton himself says) Congressional Democrats’ anti-gun efforts caused the 1994 voter revolt which—for the first time in 50 years—gave Republicans control of both houses of Congress. Democrats regained Congress in 2006 because of the unpopularity of the Iraq war. But generally the Democratic victors either said nothing about guns or openly declared their support for gun rights.

Preceding or accompanying these developments, some 40 states now require that permits to carry concealed handguns be issued to any trained, law-abiding, responsible, adult applicant. A huge, 25-year study of crime rates credits these laws for the 1990s’ vast reduction in violent crime: Criminals, unclear on who is armed, are afraid to attack. Instead they turn to less dangerous crimes, such as burglarizing unoccupied homes. These conclusions are controversial, though other studies have confirmed them. One thing is beyond doubt, however: Contrary to what anti-gun advocates predicted, after 5,000,000 carry permits have been issued, violent crime has dropped dramatically—and virtually no gun-related crimes have been committed by ordinary people with carry permits.

This result has produced a sea change in criminological opinion. As a young criminologist, Prof. Hans Toch of the State University of New York believed that “reducing the availability of the handgun will reduce firearms violence.” Thirty years of research later, he repudiated that: “When used for protection firearms can seriously inhibit aggression and can provide a psychological buffer against the fear of crime. Furthermore, the fact that national patterns show little violent crime where guns are most dense implies that guns do not elicit aggression in any meaningful way. Quite the contrary, these findings suggest that high saturations of guns in places, or something correlated with that condition, inhibit illegal aggression.” [Toch, “Research and Policy: The Case of Gun Control,” in Psychology and Social Policy, edited by Peter Sutfeld and Philip Tetlock (NY Hemisphere, 1992).]

Likewise, Prof. David Mustard wrote recently in the University of Pennsylvania Law Review: “When I started my research on guns in 1995, I passionately disliked firearms.... My views on this subject were formed primarily by media accounts of firearms, which unknowingly to me systematically emphasized the costs of firearms while virtually ignoring their benefits. I thought it obvious that passing laws that permitted law-abiding citizens to carry concealed weapons would create many problems. [But research has convinced me that]...laws that require [gun carry] permits to be granted unless the applicant has a criminal record or a history of significant mental illness reduce violent crime and have no impact on accidental deaths.” [David B. Mustard, “Culture Affects Our Beliefs About Firearms, But Data Are Also Important,” 151 U. Penn. L. Rev. 1387 (2003).]

Thus, modern criminological research confirms the wisdom of our Founding Fathers, who gave us our Constitution’s guarantee that all law-abiding, responsible adults may have guns for defense of their homes and families. As Thomas Paine put it: “The peaceable part of mankind will be continually overrun by the vile and abandoned while they neglect the means of self-defense. The supposed quietude of a good man allures the ruffian; while on the other hand, arms like laws discourage and keep the invader and the plunderer in awe, and preserve order in the world as well as property.... Horrid mischief would ensue were one [good people] deprived of the use of them; ...the weak will be come a prey to the strong.” [Writings of Thomas Paine 56 (M. Conway ed. 1894).]

The issue of national defense is helping fuel the 2008 presidential election season. But individual defense, in certain candidates’ campaign speeches, is not only easily overlooked, but judging by political history, its avoidance actually may be in the candidates’ best interest.

Don B. Kates Jr. is a criminologist and constitutional lawyer who is a Research Fellow with the Independent Institute in Oakland, California.

Go try & convince someone else
Talk about a biased article. Florida's homicide rates dues to gun deaths are through the roof. Since the gun laws have become so lax under Republicans, Floridians are afraid and not just of criminals.

We have as many, if not more, gun deaths and injuries from domestic violence, road rage, accidents, festivities as we do from criminals. There are more automatics owned by lunatic gun owners who stock pile weapons.

Where are you getting your statistics? As if we didn't know.

Where am I getting mine? Go check into the Orlando Sun Sentinel, the South Florida Sun Sentinel which have data bases showing the highest increase (over 70%) since 1994. Unless you want to say the newspapers are lying too.

Rarely does one read anything about guns saving people unless they are police guns. Vigilantes who own guns don't save lives, they endanger them.

"Where are you getting your statistics? As if we didn't know"
Good question. Where are you getting your's. Do you even have any.
Mustard collected his in a nationwide study and similar results can be seen in FBI Crime statistics.

That's because you rely on the liberal media to inform you on the subject. The article clearly states its sources, while you just say, "go read the Florida newspapers".

Your statistics are wrong
I see you are using the typically liberal media for your statistics, I'll cite a slightly less biased source and go with the fbi's statistics 1991-1995 violent crimes in Florida dropped by 10.5%. From 1993-1997 it dropped by 18.2%

I could go on here using the FBI's data or I could simply point out the Florida Law enforcement shows a consistent drop in violent crime from 1997 through 2006. (source data)

So, I've provided facts, with REAL sources indicating that your "facts" are incorrect. Are you going to go ahead and recognize that perhaps you should seek real data sources and that you are wrong? No, likely you will not respond at all and will seek a less informed audience to spout your anti-gun rhetoric.

I'd like to point out that I am not a "gun-nut" I don't personally carry a gun although I do own them (all of them I inherited so I have never purchased a gun). That said, I took the time to do the research and find the facts... I'd encourage you to do the same, you might find that you have to change you're outlook.

Your statistics are wrong
Actually, if you divide the number of firearms killings by the number of illegal aliens and convicted criminals on the streets in Florida, that rate has remained fairly stable over the last few years.

Liberal Media and Guns Issues
If you check the real statistics from the FBI and BATF, it is concluded that after the sunset provision of the assault weapons ban. The U.S. had experienced a drop in violent crimes and the use of guns in violent crime is just a small fraction. Criminals had admited that they won't attack an armed citizen because their victims might have the use of deadly force for self defense. Another example is in the aftermath of hurricane Katrina in New Orleans when Nagin ordered the ilegal confiscation of guns from his citizens and leave the defenseless from armed criminals waiting for that promised police protection that never came. Is no brainer that the second amendment is indeed an individual and fundamental right that gives us, American citizens, the right of self defense from any threat. The states of CA, NY, NJ, MA, CT, MN, NH and DC are the states that have an increase of criminal violenceand yet those are the only states that supports the failed Clinton Gun Ban Law. in conclusion, I say that gun bans and other gun control laws are nothing but a way to violate Americans their constitutional rights and and have zero effect in combating crime. The Brady campaign, Million Mom March, the Joyce Foundation and other anti-gun organizations are just paying huge amounts of money expressing their opinions without providing real documentation, statistics and evidence to prove their claims but hoping that a liberal accepts their opinions regardless the facts. If those organizations have problems with guns, they just simply have to promote gun safety education instead of gun control propaganda because banning guns will never stop crime. And by the way, the Orlando Sun Sentinel is an biased and opinionated news corporation as CNN and MSNBC. I stick with Fox News as much I stick with the NRA and the GOP (Republicans).

Brady Campaign based on lies
The Brady campaign against Handgun violence has ALWAYS been a scam. WHY? Because I KNOW the truth about the assassination attempt against President Reagan, as I was the person who provided information to the government BEFORE it happened.
The government tried to investigate, but I did not have enough information, as Hinkley was moving around alot. Hinkley did NOT want to kill the President, as a group of KNOWN subversives found Hinkley, DRUGGED HIM WITHOUT HIS KNOWLEDGE, and BRAINWASHED HIM!!!

This same group of subversives tried to assassination President Ford, during his presidency, and they tried to harm Pres. Reagan at least one additional time, during the Reagan Presidency.

I say this because I was an operative of one of America's intelligence agencies, and PROVIDED INFORMATION TO FEDERAL LAW ENFORCEMENT ALL ALONG, DURING THESE PARTS OF HISTORY!! LAW ENFORCEMENT WAS THREATENED BY CORRUPT DEMOCRAT CONGRESSMEN AND OTHERS WERE BRIBED WITH ILLEGAL NARCOTICS, TO COVER-UP THE TRUTH!!

THE NEWS MEDIA HAS KNOWN THIS AND COVERED-UP THE TRUTH, AS MOST OF THE NEWS MEDIA IS PART OF THE CRIMINALS CONSPIRACIES IN AMERICA.

Reply on the Brady Campaign
I know that the Brady Campaign is a scam and so is the Million Mom March and the Joy Foundation. They had been funneling money to each other and to the Democratic Presidential Candidates. They also are looking to control media and forcing the people to accept their views and only their views. Is pretty much exactly like Comunist propaganda. An example is the movie Run Away Jury wich they want gun manufacturers to suffer criminal charges when one of their products was used in a murder. However that proves that Toyota should be accused of murder if I run over somebody.

Clueless Michelle
I'll tell you what, Michelle... The next time you're out at night walking that poodle of yours and a criminal decides that you are going to be his next victim... Just get on your cell phone and call 911 and see if a cop can get to you before you've been brutalized... But don't worry !! I'm sure a cop will get to you in time to take a report

Gun Laws And Race Relations
"CAN WE TALK"

Gun control laws do not favor good race relations. The effects and burdens of gun control (gun restriction)laws are suffered almost entirely by law abiding, responsible, mostly white Americans who,for the mostpart don\'t need laws to pre vent violence that their not doing. Conversely,a disproportionate amount of violence in the US is concentrated in predominately non white urban areas.
This politically incorrect reality is souring race relations. We, the law abiding gun owners of America are being squeezed in a legislative vise because of violent tendencies that other demographic groups can\'t seem to control.
Not good!

Michelle, its sad to see that you don't support a woman's right to defend herself from an attacker. I guess you feel safer supporting violent criminals instead. That's very open-minded of you.

Petition against new abusive gun ban
A couple of months, I recieved an e-mail from TAPCO asking for signatures to oppose the HR 1022 "Assault Weapons Ban". The new bill is the same failed Clinton ban but with more restrictions. obviously this bill is from a NY senator who recieved a huge amount of money from Bloombergh. The petition's goal is 1,000,000 signatures and I already participated if anyone is interested to opposed this anti-constitutional bill, here's the website: http://www.thepetitionsite.com/takeaction/409898348
Is our contitutional rights that are at risk and is just not the second amendment the target. Such laws violates the first and Fourth as well.

Michelle's folly
There are in fact many instances of people saving themselves from criminal attacks with firearms, but the driveby media are loathe to report on them. Balanced reporting on gun issues is simply not part of their social agenda. You'll find some examples of these incidents in each monthly edition of the NRA's periodical,American Rifleman. Also, Bernie Goldberg detailed this phenomenon in his book,"Bias". But lets consider some national examples, such as Israel, where it's not unusual to see civilians walking around with automatic assault weapons and handguns. You'll never feel safer than you do walking the srteets of any city or town in that country, whether day or night. Consider much of Africa where the blood never seems to dry, and guns are either unavailable to or unaffordable for so many helpless victims of the most sadistic and sickening things that human beings can do to one another . Consider what's in between these two extremes, gun policy along with police powers, civil rights and privacy expectations.
I have. My conclusion: "FROM MY COLD DEAD FINGERS"

As a Jewess in the US, I would like to remind everyone that America wasn\'t won with a registered gun! Crooks are not stopped by talk, but by FIREARMS. Therefore, let\'s all put our 2nd Amendment FIRST!!

That we call original research. Too many of the anti Second Amendment people get their facts from bad movies, bad television shows and really dishonest newscasts. Try reading John Lott\'s More Guns Less Crime to see some more original research.
